4. Regina v. J. B. [Didsbury PC, June, 2007]

Client became involved in a physical altercation with a gas company meter reader resulting in the police search of his rural residential premises. Police located a marijuana grow operation and a large cache of weapons resulting in a prosecution for cultivation of marijuana, possession of marijuana for the purpose of trafficking and multiple weapons offences. The validity of the warrant to search was challenged on constitutional grounds resulting in the complete withdrawal of all drugs and weapons charges prior to commencement of the Preliminary Inquiry.
